Presumably you have other programs (getty?) running on the same line.

A workable solution for /dev/modem acceess is to create a group
'modem', make /dev/modem owner root.modem and mode 660, and make all
programs that access /dev/modem (kermit, uucico,...) setgid to modem.
That works for me. (The group is 'uucp' as I use a standard uucp
setup, but it works anyway. But I currently have no getty running.)
